Any information that we receive from you will be held in strict confidence. We never sell e-mail addresses or other information, or barter them with any one else. You are advised that information sent over the Internet is not necessarily totally secure but we will never knowingly compromise it. Our information is only sent to an "opt-in" e-mail list. You will receive e-mails only if you ask for them. And you can "opt-out" at any time.

Terms and Conditions of Sale

TERMS: Cash On Delivery (COD) including major credit cards (Visa, MasterCard, American Express and Discover/Novus) for all orders. COD for initial orders pending approval of house credit. Net 30 days cash upon approved house credit. No discount, unless otherwise specified. All claims must be made within three (3) days of receipt of goods. Prices quoted are subject to increase by the amount of any tax levied against this order by any Federal, State, County or City authority.

PRICES: Except as otherwise noted, all prices are F.O. B. our plant and are subject to such sales, use, or other taxes as may apply. All prices, specifications, and discounts now in effect, or hereinafter issued, are subject to change without notice. Proposal quotations will be firm for 30 days from presentation date unless otherwise specified by Medical Parkway Printing, Inc. (hereinafter referred to as MPP). Prices quoted are based on materials cost at the time of quotation. Any increase in materials cost between the time of quotation and the time the order is placed will be passed on at cost.

ORDER: Orders regularly entered cannot be cancelled except upon terms that will compensate against loss.

DELIVERY: Unless otherwise specified, the price quoted is F.O.B. our plant. All proposals are based on continuous and uninterrupted delivery of the order, unless specifications distinctly state otherwise. All contracts are made contingent upon wars, strikes, fires, floods, accidents or other emergencies beyond MPP’s control.

EXPERIMENTAL WORK: Experimental work performed at the customer’s request, such as composition, type and style variations, color ink variations, paper and materials, shall be charged for at current rates.

ART: Artwork furnished by MPP and invoiced to the customer will become the property of the customer after payment for same is received.

PAPER STOCK: Paper stock furnished by the customer shall be properly packed, free from dirt, grit, torn sheets, bad splices, etc., and of proper quality for printing requirements. Additional costs due to delays or impaired production due to improper packing or quality of the customer furnished stock shall be charged to the customer.

CUSTOMER’S PROPERTY: All customer’s property, including raw materials, printed stock, artwork, engravings, paste-ups, mechanicals, typesetting copy, etc., that is stored with MPP is at customer’s risk and the typesetter/printer is not liable for any loss or damage thereto caused by fire, water leakage, theft, negligence, insects, rodents, or any cause beyond MPP’s control. It is understood that the gratuitous storage of customer’s property is solely for the benefit of the customer.

INDEMNITY: In addition to the foregoing, it is further understood and agreed that the customer shall indemnify and save MPP harmless from and against loss, cost damage, liability and expenses, including attorney’s fees, arising out of or in connection with any and all claims for libel, invasion of right of privacy, copyright infringement or plagiarism or claims that any other rights, legal or equitable, have been infringed by any matter included in the material printed hereunder for the customer: provided that such claims are based on matter included or contained in material or copy furnished to MPP by or on behalf of the customer and are not based on any unauthorized deletions from or additions to such material or copy, and, provided further, that MPP shall promptly notify the customer of any and all such claims, and immediately upon receipt of summons or other notice of suit shall notify the customer thereof in writing and shall afford the customer an opportunity to appear in and defend such suit for and on behalf of MPP. The customer shall pay all costs of such defense, including attorney’s fees, whether it shall be conducted by the customer or the printer, provided that notice of suite shall have been given to the customer as aforesaid. It is also understood that upon MPP’s receipt of such notice of such claims or suit, MPP may withhold delivery to the customer the material to be printed or typeset hereunder, unless the customer shall promptly deposit with MPP security satisfactory to MPP securing the customer’s obligation to indemnify MPP hereunder.
